Welcome to our webpage www.almabloom.com (hereinafter, the “Web”).

These General Conditions of sale are exclusively related to the items sold in the Web. The client may systematically consult them on the Web at the time of entering an order.

Consequently, the fact of doing an order involves the full and unreserved acceptance of these general conditions for the client’s part, excluding any other condition that is in the leaflets, the catalogues that are published by the seller and, in particular, the current conditions that exist in the Alma Bloom stores.

Therefore, all opposite condition planned by the client will be, except in case of express acceptance, unenforceable to Alma Bloom, whatever moment the condition has come to their attention. The fact that Alma Bloom do not prevail one of these general conditions of sale at any given time, shall not be interpreted as a resign to make afterwards prevail any of these conditions.

We strive to guarantee the best possible accuracy and updating information published in the Web, and we reserve the right to correct its content at any time and without notice.

If a condition were to fail, it would be regulated by the current Spanish purposes and laws in the distance sale field.

Aim

These general conditions regulate the sale of Alma Bloom’s “lingerie” and “fashion accessories” products presented in the Web by Alma Bloom S.L.U company, with a share capital of 3,000€, registered in the Trade Registry of the Trade Register of Madrid, volume 31.501, sheet 180, section 8, page M-566992, registration 1st, domiciled in Las Rozas de Madrid, Piedralaves Street, 1 ground floor A, Spain, (hereinafter, “Alma Bloom”) to any individual that is not a trader and exclusively adult (hereinafter, the “Client”).

Product availability

Delivery to all the EU countries. Products are available for sale depending on the limit of stocks.

Prices

Prices are shown in Euros for the countries that use this currency. The costs of shipping fee are added to these prices in the event that these expenses are applied.

The order supposes the acceptance of the prices and descriptions of products available for sale. Any disagreements relating to this point will lead to an eventual “change / refund” as provided below.

We reserve the right to modify prices and product descriptions in case of increased costs, especially in VAT, in case of typographical error or writing.

Despite our vigilance, it may appear on our webpage pricing errors for various reasons (computer bug, manual mistake, technical error…). If the orders have been made with pricing errors or manifestly insignificant (low price), they will be cancelled, even if they have been confirmed by our services. In this case, we will notify each of the affected clients so they can, if they wish, redo the order with the correct and exact prices.

 

Order

All order made in the Web will be exclusively paid online by the credit card chosen by the client: Visa, Visa Electron, Mastercard, American Express, Paypal, E-Gift Card and all the existing versions of these cards in the different countries where we make deliveries.

The order will be only registered after entering your credit card number to carry out the payment.

This payment will have a final confirmation by the GIE bank card. All users of the Web that do not own a client number will have to carry out a registration process so they can get the customer number. This number is personal. Any loss or oblivion must be reported to Alma Bloom as soon as possible by contacting with the customer service, whose details are shown above. In all cases, the fact of entering online the card number and the final order confirmation will testify to the integrity of your order in accordance with the law of 13th March 2000 and will involve the requirement of the committed sums by the selection of the items listed on the delivery order. This confirmation serves as signature and as specific acceptance of all operations performed in the Web. However, in case of fraudulent use of your credit card, we suggest you, as soon as you have evidence of such use, to contact our customer service. The final confirmation of the order is registered after the confirmation of the payment.

After having done the order, we will send you a confirmation entry email of it, with a summary of the ordered items and the delivery address.

 

Product delivery/change

From the date of the order, you have a period of 30 days to return an item (unused and in its original packaging).

Warning: Items that are returned incomplete, spoiled, damaged or soiled by the customer will not be accepted.

Change or return in a store: For all the orders done in our webpage, you cannot make any change or return in a store.

Refund in case of return to the warehouse: The sending of goods to our warehouse can only be made in case of return, we do not accept changes. The postage and packing will be in charge of the client, except from the return that is owing to our mistake. The refund will be made after the sending receipt. You will receive the purchase price in the same way that you made the purchase.

In both cases, the items should be accompanied by the corresponding receipt. If you paid with a gift card, or if your credit card has expired, our customer service will contact you to do the refund by transfer or cheque.

 

Delivery

Where can I get my order?

You can receive it in the address that you choose (home, work, etc., never in Post Office box) or in the Alma Bloom store that you wish.

How long will take my order to arrive?

The delivery terms depend on the selected type of sending. For store delivery are between 3 and 5 working days, for the standard delivery, between 2 and 3 working days (for Ceuta and Melilla the transit will be between 3 and 5 days) and for express delivery, between 1 and 2 working days (for Ceuta and Melilla the transit will be between 2 and 4 days).

How much do I have to pay for delivery costs?

For store delivery, it is free.

Standard delivery, 2-3 working days – 4.99 €

Express delivery, 24 hour – 5.99 €

* For Ceuta and Melilla, the transit will be: Standard, between 3 and 5 days; and Express between 2 and 4 days.

EU delivery

Between 2 and 3 working days.

France and Portugal 12.49 €

Germany, Austria, Italy, United Kingdom 15.09 €

Can I follow the status of my order?

Yes, you will be able to see the status of the order through “my account”. If you are not registered, click on the link “Ordering Information” of the confirmation email to do the track.

What is the process for home delivery?

If you have chosen the home delivery, we will send you a confirmation email of sending (when your order is going to leave the warehouse), another with the tracking number (with a link to the webpage of the courier company) and, finally, the carrier will contact you with a SMS or an email to inform you about the order delivery.

Which is the process for store delivery?

If you have chosen the store delivery, we will inform you of the goods arrival through a SMS (you will have 15 days to pick it up). You must present your order number and the ID card of the person who will pick it up.

Warning: during certain periods (sales, private sales, happy hours…) our handling times may be higher due to the large number of sending that we have to process.

In case of extended delivery delay, you should note the delay within 30 days, by writing an email to the following address: attclienteweb@almablom.com.

When we receive the message, we will contact you by postal service to open an investigation.

Complaint

Our customer service team is at your disposal for any questions related to your order.

In case of litigation, we beg you to point out the order number and the exact reason of your request.

After resolving the problem, if it is necessary to make a refund, we will make the deposit directly to your bank account.

You cannot carry out inquiries to our carriers to know the trajectory of an order once exceeded a period of 30 days.

And, after 2 months of the opening of a complaint document, it will not be accepted any refund request. Our banking agent allows us to deposit the respective money for operations within a maximum of 60 days.

Privacy policy

ALMA BLOOM S.L.U. guarantees the strictest confidentiality in the collection and treatment of data provided by users by the Internet or any other ways. This information will be treated with the provisions of the Organic Law 15/1999, 13rd December, on Protection of Personal Data (hereinafter, “LOPD”) and other regulations about protection of personal data. Litigation

The simple fact of doing an order involves the full acceptance of the general conditions of sale. These sale conditions are subjected to the Spanish laws.

Any litigation would be under the exclusive jurisdiction of Madrid – Spain courts.

Secure payment

Alma Bloom uses the PayPal secure payment service, which has the SSL safety regulations. The confidential data (card number, expiration date) are communicated directly after the encoding to the PayPal server and they do not move around in our server at any time.

The PayPal server is, at the same time, directly connected to the servers of banks of each respective country.

Liability

The provided products follow the current Spanish legislation.

The photographs and the reproduced texts to illustrate the provided products are not contractual.

Consequently, the responsibility of Alma Bloom would not be affected in case of an error of one of the photographs or texts.

The Alma Bloom company will not be considered responsible for the lack of execution of the concluded contract in case of stock shortage or unavailability of the product, of force majeure, of disruption or of total or partial strike, particularly the postal services and transport and / or communication means, in case of resulting damages from fraudulent intrusion by a third party who could cause a modification of the information contained in the Web and, more generally, for all damages, direct or indirect, whatever its causes, origins, nature or consequences, caused because of any person access to the webpage or the inability to access to it, the use of the webpage and / or any credit agreed directly or indirectly from the latter information.

Alma Bloom will not incur any liability for any indirect damage due to loss of operation, loss of profits, loss of opportunities, damages or expenses.

Alma Bloom remembers that, in accordance with the Civil Code article 162, the minors that are not emancipated do not havecontractualcapacity. Consequently, the orders that are set aside forminors must previously have theparental consent. With the accidental collection of personal information relating to a minor, the parental consent has the ability tooppose to its conservation and/ortransmission tothird parties.

Hypertext links can redirect to other different webpages. Alma Bloom is exempt of all responsibilities in the event that the content of these webpages is against to the current legal and statutory regulations.

Intellectual Property

The usage of this web service www.almabloom.com is reserved for a strictly personal use.

It is prohibited the reproduction, distribution, public communication and full or partial transformation of the contents of the webpage without the authorization of Alma Bloom, constituting a violation of the existing legislation on industrial and intellectual property.

Likewise, all the trade names, designs, contents, brands, images or distinctive signs of any kind of content in the webpage are protected by law. The user will use the services of the webpage with respect to its rights and will not acquire any rights at any time in relation with them.

Duration

These conditions apply throughout the period of online publishing products offered for sale by Alma Bloom.

Proof

Computerized registers maintained in Alma Bloom’s information systems and its contributors in conditions of reasonable safety will be considered as proof of communication, orders and payments made between Alma Bloom and the client.

Applicable texts – Jurisdiction

This contract is subject to Spanish law. The language of this contract is the Spanish. Any litigation would be under the competence of the Spanish courts.

Change of the general conditions of sale

Considering the possible evolutions of the Web, Alma Bloom reserves the possibility to adapt or modify these general conditions of sale at any time. The new general sale conditions will be, where applicable, made public to the customer by online modification, and will be applicable only to the sales made subsequently to the modification.
